1. Overview

Welcome to The Passport Game (“the Service”), operated by POAP Inc. (“we,” “us,” or “our”).

The Service allows users to create and collect digital stamps based on their presence at real-world locations, which may be inferred using device location data, metadata (including EXIF data from photos), and other signals.

By using the Service, you agree to these Terms.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction).

You may not use the Service if:

  • You are subject to sanctions or located in a jurisdiction where use is prohibited under applicable law
  • You are listed on any applicable government restricted party list

3. Accounts

You may need to create an account to access certain features.

You are responsible for:

  • Maintaining the confidentiality of your account
  • All activity that occurs under your account

We may suspend or terminate accounts at our discretion.

4. How Digital Stamps Work

The Service issues digital stamps based on signals such as:

  • GPS or device location data
  • Photo metadata (including EXIF data)
  • Time and contextual information
  • Other verification methods we may introduce

Important:

  • Digital stamps are not proof of physical presence, identity, or participation
  • Verification systems are inherently imperfect and may be subject to error, manipulation, or circumvention
  • We do not guarantee the accuracy, authenticity, or reliability of any stamp
  • We reserve the right to deny issuance, or to invalidate or revoke stamps at any time, including retroactively

Digital stamps are intended for informational, experiential, or entertainment purposes only.

5. User Responsibilities

You agree not to:

  • Falsify location data, metadata, or other signals
  • Upload altered, misleading, or fabricated content
  • Interfere with or disrupt the Service

You are responsible for your use of the Service and any content you submit.

6. Anti-Gaming and Enforcement

We are committed to maintaining the integrity of the Service and the digital stamps issued through it.

You may not attempt to manipulate, interfere with, or circumvent the systems used to determine eligibility for digital stamps. This includes, but is not limited to:

  • Falsifying or spoofing location data
  • Modifying, fabricating, or reusing metadata (including EXIF data)
  • Using VPNs, proxies, emulators, modified devices, or other tools to misrepresent your location or activity
  • Submitting altered, staged, or misleading content intended to deceive verification systems

We may use automated systems, manual review, and third-party tools to detect such behavior.

We reserve the right, at our sole discretion, to:

  • Deny issuance of any digital stamp
  • Revoke or invalidate previously issued stamps, including retroactively
  • Remove content or restrict account functionality
  • Suspend or terminate accounts

Our determinations regarding manipulation or abuse are final.

7. User Content

You may upload content, including photos.

You retain ownership of your content, but you grant us a worldwide, non-exclusive, royalty-free license to:

  • Use, process, and analyze content to operate and improve the Service
  • Extract and process metadata (including EXIF data)
  • Display content as part of the user experience

You represent that:

  • You have the rights to upload the content
  • The content does not violate any law or third-party rights

8. Privacy and Data Use

We collect and process:

  • Location data
  • Device information and metadata (including EXIF data)
  • Account information

This processing is necessary to operate the Service.

9. Location Data and User Risk Disclosure

The Service may require you to share precise location data and metadata derived from your device, including information embedded in photos.

By using the Service, you acknowledge and agree that:

  • Location data can be sensitive and may reveal personal information about your movements, habits, or whereabouts
  • Sharing location data or content may expose you to risks, including unwanted attention, surveillance, or misuse by third parties
  • We cannot guarantee that your location data or associated content will remain private or secure at all times

You are solely responsible for deciding when, where, and how to use the Service, and for any risks associated with sharing your location or content.

10. Prohibited Uses

You may not use the Service to:

  • Violate any laws or regulations
  • Circumvent sanctions or export controls
  • Track or surveil others without consent
  • Submit false or misleading information

11. Sanctions and Compliance

You agree not to use the Service if doing so would violate applicable sanctions laws.

We may:

  • Restrict access in certain jurisdictions
  • Block or terminate accounts to comply with legal requirements

12. Intellectual Property

The Service, including its software, design, and content (excluding user content), is owned by POAP Inc.

You may not:

  • Copy, modify, or distribute the Service
  • Reverse engineer or attempt to extract source code

13. Beta Features and Experimental Services

The Service may include features, products, or functionality that are in a beta, pilot, or experimental stage (“Beta Features”).

Beta Features may:

  • Be incomplete, unstable, or subject to errors
  • Change materially or be discontinued at any time without notice
  • Produce unexpected or inaccurate results, including with respect to digital stamp issuance

You understand and agree that:

  • Your use of Beta Features is at your own risk
  • We are not obligated to provide support, maintenance, or continued access to Beta Features
  • We may modify, suspend, or terminate Beta Features at any time without liability

Feedback you provide regarding Beta Features may be used by us without restriction or compensation.

14. Disclaimers

The Service is provided “as is” and “as available.”

We do not guarantee:

  • Accuracy of location verification
  • Authenticity or reliability of digital stamps
  • Continuous, secure, or error-free operation

Digital stamps are not:

  • Proof of presence, identity, or achievement
  • Legal, financial, or official records

15. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for:

  • Loss of data or digital stamps
  • Errors in verification
  • User misuse, fraud, or third-party reliance on stamps

Our total liability is limited to the amount you paid us in the past 12 months (or $100 if none).

16. Termination

We may suspend or terminate your access at any time, including for:

  • Violations of these Terms
  • Suspected fraud or abuse
  • Legal or regulatory reasons

17. Changes to the Service

We may modify or discontinue the Service at any time.

This includes:

  • Changing how stamps are issued or validated
  • Removing or altering features

18. Governing Law

These Terms are governed by the laws of New York, United States, without regard to conflict of law principles.
